Select Board Minutes: May 30, 2017

Selectmen Present:  Allan Bailey and Curtis Hopkins


Chairman Bailey opened the meeting at 6:32 pm.

Forensic Audit – Chairman Bailey did some research on the money that was set aside from the restitution from Cindy Satas. The court document listed all of the money that Cindy Satas paid as restitution to the Town of Troy.  The Town of Troy set the $10,000 aside for a forensic audit.  So the money does not need to be returned if it is not all spent.

Dick DeSeve from NH DES – Mr. DeSeve sent a letter explaining his call with Carl Hagstrom about the complaint on the property with the septic system issues.  

Richard Hull @ EPA – Mr. Hull sent a letter about the signs that will be going up at the Troy Mills landfill site.

ADA Coordinator letter from State – Letter states since there are more than 50 employees there needs to be an ADA coordinator appointed. Chairman Bailey stated for Mrs. Fox to be the ADA Coordinator and call to inform state and also so what it entails.

Health Officer Letter from State of NH – No requirement for health officer

Mike Jasmine Letter – Mr. Jasmine stated he would be willing to come meet with the Select Board and go over requirements and steps for getting a building code enforcer.

Health Trust – Letter from Si Little, Selectwoman Guelcher tried to call 2 times. Chairman Bailey wants Mrs. Fox to call and see if the Town has insure her or can we drop her of the health insurance. Chairman Bailey would also like to know how her premium is paid

DRA Letter on warrant articles – money has been put in the hands of the trustees of the trust funds and are waiting on signatures.

Norman Whitney – Mr. Whitney had a call with Selectmen Hopkins about getting KRT to come out to take a look at property. Selectmen Hopkins has George from KRT coming out on June 7 at 8:00 am.

Joel Thompson – Mr. Thompson wanted to inform the Select Board that while he was building the stairs on the gazebo he noticed that the gazebo is leaning to the east.  The roof of the gazebo is very heavy. Mr. Thompson thinks a structural engineer should be contacted to take a look at the gazebo.  Mr. Thompson also wanted to see if there was anything he needed to do with the Town to obtain a beer & wine license for Grandpa Joe’s. Chairman Bailey stated that the state handles everything and a letter from the Town will have to be sent to the State when the State requests it.

Josh Ellis, Phaedra Lady, Jim Dicey about Culverts – Chairman Bailey did research and it is homeowners responsibility to take care of the culverts. Mr. Ellis stated that he thought that applied to state highways. Mr. Cummings asked doesn’t that RSA apply to certain classes of roads. Mr. Ellis stated it is the responsibility of the owner but who is supposed to clean it. Chairman Bailey stated that it only goes for the driveway cut. Mr. Dicey stated that Mr. Ellis’s culvert was extended.  Mr. Ellis stated that Mr. Dicey signed for the culvert to be extended. Chairman Bailey asked Mr. Dicey when was the last time the ditches on South St have been done.  Mr. Dicey stated 3 years ago.  Mr. Dicey stated the problem is the ledge that was dug into.  Selectmen Hopkins asked Mr. Ellis did you say that Mr. Dicey took the fire truck up and cleaned out Bucky Sheats culvert. Mr. Dicey stated yes he did but because the driveway was washing away and the culvert was completely blocked and after hours of Mr. Sheats trying to get it unblocked he couldn’t. Mr. Ellis asked Mr. Dicey if he tarred an end of a driveway on Bigelow Hill Rd a few years ago. Mr. Dicey stated yes he did but because the mail lady was falling off the edge of the tar and it was an issue for her. Mrs. Lady stated that her culvert was not cleaned out 3 years ago. Mr. Dicey stated to Mrs. Lady that her culvert was not installed by the contractor correctly and it is a foot to deep. Selectmen Hopkins would like to know how many culverts are effected. Mr. Ellis stated that most of them on South St. Selectmen Hopkins is there water running over the roads where these culverts have issues. Chairman Bailey we will look at the culvert and see what we can do that is legal. Mr. Ellis stated that he would like Mr. Dicey to draw a line on the road where he can legally work.

Beacon Light on South Main St. – Mr. Dicey thinks the Town should send a letter to the State of NH Dot about the beacon light they took down.  There has been 2 accidents since the beacon light has been taken down.

Dan Guay, Tina Guay, Gail Thomas, Scott Ellis – Mrs. Guay spoke with Jamie Dow at the DRA and was told that we knew that this warrant article to pay the legal fees was not going to be accepted by the DRA.  Mrs. Guay stated that Mike Bentley’s lawyer bills were paid for out of ambulance funds. Chairman Bailey stated that we don’t know anything about that. Mrs. Guay would like to know how the ambulance money got moved to another account because as far as what she knew it was not to be moved till the court case was complete. Mrs. Guay thinks the Town should pay for their legal fees. Mr. B. Drugg stated that he also spoke to Jamie Dow at the DRA and asked what the options were for paying for the legal fees for the former ambulance personnel. Mrs. Dow told Mr. B. Drugg that there is no legal way to pay the bills. The money from the ambulance was put in a trust fund at Town meeting. Mr. B. Drugg states that we should reach out to the Town’s people and raise the money to pay the legal fees.

Norm Dion, Mike Walsh, Trustees of the Trust Funds – Mr. Dion wants to know from the Select Board what they would like for the future from the Trustees.  Mr. Dion thanked the Select Board for moving the bequest money so quickly once DRA letter came. Mr. Dion stated that the warrant article for the bequest money needs to be rewritten and is not good the way it is, it needs a purpose and method for the money. Mr. Dion think the ideas should be open for everyone to vote on. Mr. Dion stated that they are going to put the money in a CD.  Mr. Walsh stated that they wanted to invest it. Chairman Bailey stated that we asked Jamie Dow from the DRA to look deeper into RSA 35 and get the exact wording. Mr. Walsh stated the Trustees wish is to get this money invested. Mr. B. Drugg stated that since they are the custodians of the money then they can invest it in more than a CD. Chairman Bailey stated it should be for the Town not for a basic purpose.  Mr. Dion can we invest all the money.  Chairman Bailey and Selectmen Hopkins said yes invest the money. Mr. Dion asked what would be done with money.  Chairman Bailey stated that a public hearing will be held on it before it is time to write up the warrant articles for next year’s Town meeting. Mr. Walsh asked whether town council was contacted before the money from the bequest was spent. Chairman Bailey said that all the advice came from Terry Knowles at Charitable Trust and from the DRA. Chairman Bailey stated the original plan was to put it in a trust fund and let it sit.
