SELECT BOARD MEETING MINUTES
TOWN OF TROY
Monday, November 28, 2016 5:00 p.m.
Selectmen Present: Barbara Guelcher, Allan Bailey and William T. Matson

Selectmen Matson called the meeting to order at 5:00 p.m.
Present: Fred Earle, Dan Drugg, Jim Dicey, Robert Stearns
Chairman Matson MOVED to accept the Selectmen’s Meeting minutes from November 21, 2016 SECOND Selectmen Bailey VOTE unanimous
Chairman Matson asked Mr. Earle what brought him to the Selectmen’s Meeting this evening.Mr. Earle stated that he had read where the bequest money had been spent and would like to ask a few questions. Mr. Earle wanted to know about repairs that are needed for the Library, Cheshire Railroad Depot, and the Bandstand on the Common. Selectmen Bailey explained the Libraryrepairs. Chairman Matson explained the Railroad Depot repairs. Selectwoman Guelcher explained the Bandstand repairs. Mr. Earle also asked about the money that was given to the non-profit agencies in Town. Chairman Matson explained the donations that were given to the Troy PTCO and to My Neighbor’s House.
Jim Dicey – Mr. Dicey wanted to come in and let the Select Board know that the State Fire Marshal went to the Samuel E. Paul Community Center and did an inspection in regards to the complaints from Janet McCullough and the Recreation Committee. The complaint was that the front doors were not ADA compliant. Mr. Dicey stated that at the time the building was built it was to code but now the doors are not to code they are supposed to swing out. DA Brothers gave a quote of $10,574 to change out the doors and make them compliant. Trim, railings, clapboards all need to be taken down to be able to replace the doors. Mr. Dicey has 3 options to get the doors replaced. First option would be to go to Peter Paul and ask him for the money, Mr. Dicey states that he is against this option. The second option would be to go to Town Meeting with a special warrant article or to add into the budget for the SEP Community Center but if he is to do that any functions that happen at the building will need to have someone standing at the door or shut the building down till after Town Meeting when the repairs can be made if approved. Option three the Select Board could vote to use the bequest money to make the repairs as soon as possible.

Mr. Dicey got the name and number of Ginburg properties who has redone many Mill properties in the State of NH.
Sherry Carter, Kathy Lang, Deanna Savola from Troy PTCO – Mrs. Carter would like verification of the donation from the bequest that was given to the Troy PTCO. Set-up checking account under the Troy PTCO tax id #. Signors on checking account need to be principal and a Select Board Member. When money is requested it has to be approved by principal and a Select Board member. Selectmen Bailey stated that we need to put details in writing as to how and what money can get used for.
Chairman Matson called a 5 minute break.
Chairman Matson reopened meeting
Present: Dan Guay, Justine Guay, Amy Willey, Melanie Ellis, Gail Thomas, Mark Huntoon, Todd Carter, Scott Meader
Mrs. Guay wants to ask the Board of Engineers to pay for the lawyer fees for Mr. Guay that are being incurred because of the Troy Ambulance Inc. Mrs. Guay also states that Lynn Rust, CPA has never been asked to file returns or annual reports from 2012 to present. Mrs. Guay wants the Town of Troy to pay Lynn Rust to file the returns. Ms. Willey has the same request. Ms. Ellis has the same request. Mrs. Thomas also has the same request. Mrs. Guay states that Steve Bonnet spoke to Mr. Donovan at the AG’s office and he states that Mr. Guay is still liable till 2012 tax returns are filed. Chairman Matson read the email that was received on November 28, 2016 from Michael Bentley to Lynn Rust then forwarded to all parties involved. Selectmen Bailey stated that the Town did take all the assets of Troy Ambulance Inc., and that all bills that came in were paid. Mrs. Guay is making a motion for the town to get Lynn Rust the information needed to file the returns. Chairman Matson stated that the information was forwarded on to Mr. Rust today. Selectmen Bailey stated that the Board is not sure if it is legal to pay the attorney fees for the individuals involved. Mrs. Guay would like support from the Select Board to get all of this mess to go away. Mrs. Guay stated that if this goes further that she will make sure the Town of Troy gets dragged into court. Chairman Matson will have Mrs. Fox check with the DRA about paying legal fees. Mrs. Guay wants to know if an insurance claim can be filed to pay for the individual’s lawyer costs. Chairman Matson will call Gallaher Bassett who has taken over for Property Liability Trust and see if a claim can be filed.
Mark Huntoon, Todd Carter, Scott Meader – Ambulance Budget – Went over payroll costs to pay the volunteers for each call that they respond to.
Selectwoman Guelcher stated that she received a call from a resident on Granite St. The neighbors are concerned with 5 Granite St. Mrs. Fox will call William Paju and find out the status of the property. Selectmen Bailey stated that Mrs. Fox would let Selectwoman Guelcher know what the status of the property is. If Selectwoman Guelcher isn’t satisfied with the answer she will write a letter to Mr. Paju.
Selectmen Bailey states we will not change Moderator or Supervisors of the Checklist line items cause not a clear understanding from DRA.
