SELECT BOARD MEETING MINUTES
TOWN OF TROY
Monday, February 1, 2016 4:00 p.m.
Selectmen Present: Howard M. Sheats, Jr., Allan Bailey and William T. Matson
Chairman Sheats called the meeting to order at 4:00 p.m.
PRESENT: Attorney Little, Steve Patten, NH Timberland Association.
Selectmen Matson MOVED to wait till later in the meeting to approve the Selectmen Meeting Minutes from January 25, 2016 SECOND Selectmen Bailey VOTE unanimous
Selectmen Matson MOVED to go into Non-Public Session Selectmen Bailey asked if we were the defendant Selectmen Matson said no Selectmen Bailey said that we can’t go into non-public session.
Jim Dicey – End of Granite St where the Town Truck turns around the new owner of the property doesn’t want the town turning around there. Mr. Dicey wants to know if there was ever an easement in place for this. Attorney Little stated that if there was a verbal easement that was given by the previous property owner that it can be revoked.
Keith Thibault @ SCS – 35 Central Sq. 1st floor is all renovated. The 2nd and 3rd floor need renovation. Only drawback is parking. Mr. Thibault suggests we contact Mark @ Shelter From the Storm in Jaffrey. Mr. Thibault also suggested not to go after Federal money if you want to keep the decisions within the board of the non-profit. Mr. Thibault stated the property taxes that they received for Senior Housing would not change.
Budget – Selectmen Bailey stated that the Budget Committee still needed to work on Capital Reserve Funds. Mrs. Fox stated that Fire Chief Huntoon had informed her that the Mutual Aid line item went up for 2016 and that the Department would need to increase its budget. Selectmen Bailey MOVED to increase the mutual aid line item from $19,000 to $21,385 SECOND Selectmen Matson VOTE unanimous Selectmen Matson asked if we would be putting any money in the Selectmen budget for the Website. Selectmen Bailey MOVED to increase the computer service line item for the Selectmen’s Budget from $14,641 to 15,900 for website services SECOND Selectmen Matson VOTE unanimous
Selectmen Matson asked Attorney Little what needed to be done to form the non-profit legally. Attorney Little stated that the State is easy to form the non-profit but the federal is where there is a lot to do.
Selectmen Matson stated we set-up a meeting with Mr. Thibault to look at the building.
Noise Ordinance – Attorney Little suggest to bar truck traffic on Town Roads. Selectmen Matson asked if we had to list the roads. Attorney Little stated that we would have to list and post the roads.
Steve Patten, NH Timberlands Association – Mr. Patten stated that he would support a lawsuit against the town if the ordinance was passed. Mr. Patten feels that the loggers pay road tax andthey should be able to use the roads. The Select Board asked Attorney Little to write up the ordinance. The Select Board asked Mr. Dicey to look up the price of the signs to post the roads.
Selectmen Matson asked Mr. Patten what his thoughts were on road bond for loggers. Mr. Dicey thinks we should bond for roads.
Building Code Enforcer – Town has not enacted for a building inspector. Need to reenact a building code enforcer. Attorney Little stated that there are people that can be hired to come in do the job of a building code enforcer. Attorney Little would forward over some names of building code enforcers.
Chairman Sheats asked Attorney Little about the car that was towed from Richmond by J&J Auto Body per request of the Town of Richmond Police Department. Is it a Town of Troy issue if J&J Auto Body would not release the car to the owner? Attorney Little stated that it is not a Town of Troy issue and that he suggests the Select Board write her a letter saying that the Town of Troy is not involved in this issue and that this will be the last correspondence. Selectmen Matson MOVED to have Mrs. Fox draft up letter and send to her SECOND Chairman Sheats VOTE unanimous
Dam Troy Mills – Will need to get in contact with the State of NH
Rooster Ordinance – Attorney Little states this is a zoning ordinance that controls agriculture
Selectmen Bailey MOVED to accept Selectmen Meeting minutes from January 25, 2016 SECOND Selectmen Matson VOTE unanimous
Selectmen Bailey MOVED to have a Public Hearing on February 16, 2015 for noise ordinance SECOND Selectmen Matson VOTE unanimous
Call The Rogers by March 1st to fill out elderly deferral and Selectmen are willing to meet with them if need be.
Winter parking ban ordinance – Signed by the Select Board
West Hill Rd Complaint – Selectmen Matson MOVED to forward complaint to Jim Dicey to check West Hill Rd SECOND Selectmen Bailey VOTE unanimous
23 Monadnock St Eviction Complaint – Selectmen Matson gave Joseph Prelas the number for Cathy at Southwester Community Service. SWS is working on finding a home for Mr. Prelas.
Government records letter for Mackey Rd from lawyer will be given to Janet McCullough to research.
Superfund Site – Mr. Dicey would like to know who owns this property
Select Board request that Mr. Dicey take the Christmas Lights down.
Selectmen Bailey updated the Select Board on the budget committee and their last meeting is Thursday, February 4, 2016.
Criminal Checks – Table for 2 weeks
