SELECT BOARD MEETING MINUTES

TOWN OF TROY

Monday, February 9, 2016 4:00 p.m.

Selectmen Present: Howard M. Sheats, Jr., Allan Bailey and William T. Matson

                                                                                                                       

Selectmen Bailey called the meeting to order at 3:58 p.m.

PRESENT: Wade Paight, Steve Patten, NH Timberland Association.

Selectmen Bailey MOVED to wait till later in the meeting to approve the Selectmen Meeting Minutes from February 1, 2016 SECOND Selectmen Matson VOTE unanimous

Steve Patten, NH Timberlands Association – Mr. Patten is not sure why the intent to cut is not signed yet and he feels like it is because the noise ordinance is not in place yet. Mr. Patten states that is only a few more weeks of cutting and the job will be done. Mr. Patten thinks we should keep the intent to cut separate from the noise ordinance. Selectmen Matson asked Mr. Paight how long he has known about the complaint of the early trucking. Mr. Paight said he has known for a few weeks. Selectmen Matson stated that he has known about the complaint but still continues to truck logs at early morning hours. Mr. Paight stated that he is not trucking early every day and not really early. Selectmen Matson stated that it has continued because the trucks go by his house and he has seen them. Selectmen Matson stated that Attorney Little is drafting up the ordinance so that everything is legal and so it can be enforced by the Police Department. Mr. Paight stated he just wants to finish the job before the roads are posted. Selectmen Matson wants to compromise on the time before the Select Board signs the intent to cut and Selectmen Matson would like to see between 6:00 am to 7:00 am. Mr. Paight stated that if the intent to cut is signed he will be done in a week and a half and that his truck will not be on the road till 5:30 am. Selectmen Matson said he is okay with 6:00 am. Selectmen Matson MOVED to accept intent to cut with the agreement that the truck will not be on the road till 6:00 am SECOND Selectmen Bailey VOTE unanimous Mr. Paight asked the Selectmen not to sign the intent to cut yet because he is not sure he wants to agree on the 6:00 am. Mr. Paight asked for a few minutes to speak with Mr. Patten on the matter before making a decision. Mr. Paight agreed with the 6:00 am trucking and shook hands with Selectmen Matson and Selectmen Bailey. Mr. Paight stated that he would have one more early morning on 2/10/16 and after that he would be on the road at 6:00 am.

4:46 pm – Conference call with John Nalin from 42 Granite St. Selectmen Matson stated we asked our lawyer to look into the deeds to see if anything was ever put in. Selectmen Matson asked if it would be okay if the town trucks turned around at his property when they are sanding and plowing. Mr. Nalin agreed that it would be okay to do that. Selectmen Matson told Mr. Nalin that he would let Jim Dicey know to only turn around on Mr. Nalin’s property when he is plowing or sanding.

The Select Board made a call to Mr. Dicey in regards to why he is turning around at the end of Granite St when he is not plowing and sanding. Mr. Dicey stated that Mr. Nalin must be getting the truck confused with another truck that looks like the Town truck.

Shawn Bergeron land at the end of Richmond Rd. Map 31 Lot 5, Map 38 Lot 1, Map 31 Lot 4 – The Select Board agreed that Mr. Bergeron’s clients would have to go to the ZBA or planning board for land use changes. The Select Board stated it is a class VI Road and the Town does not give building permits for these types of roads so to be able to build a shooting range the client would have to have exemptions made. Selectmen Bailey will write a letter to Mr. Bergeron in regards to this property.

Shirley O’Dett property tax abatement – Selectmen Matson asked Mrs. Fox to get tax info from the tax collector.

Rooster Complaint on Prospect St – Selectmen Matson asked Mrs. Fox to call Mr. Sawyer and let him know that he needs to call the police and file a noise complaint when he is awaken by the rooster.

Selectmen Bailey gave an update on the Budget Committee
